RoSocial Terms of Service

IMPORTANT — PLEASE READ CAREFULLY: These Terms of Service (“Terms”) constitute a legally binding agreement between you and RoSocial Platforms (“RoSocial”, “we”, “us”, or “our”), the operator of the RoSocial platform at rosocial.net (“the Platform” or “the Service”). By accessing, registering for, or using the Service in any capacity, you agree to be bound by these Terms, our Privacy Policy, our Community Guidelines, and any other policies referenced herein.

If you do not agree with these Terms, you must not access or use our Service. If you are under the age of 18, your parent or legal guardian must read and agree to these Terms on your behalf.

2. Eligibility and Age Requirements

2.1 Minimum Age

You must be at least 13 years of age to use this Service. By using this Service and agreeing to these Terms, you represent and warrant that you are at least 13 years of age. We do not knowingly allow any person under the age of 13 to register for or use our Service.

2.2 Parental Consent for Users Aged 13–17

If you are between 13 and 17 years of age, you must have the permission of a parent or legal guardian to use the Service. By using the Service, you confirm that your parent or legal guardian has read, understood, and agreed to these Terms on your behalf.

Parents and guardians are responsible for supervising minors' use of the platform and are encouraged to use available parental controls and account supervision tools we provide.

2.3 UK Children's Code Compliance

RoSocial is committed to compliance with the UK Age Appropriate Design Code (Children's Code). For users identified as or reasonably likely to be under 18 years of age, we apply enhanced privacy protections, including:

  • High privacy settings applied by default

  • No profiling of children for the purposes of advertising

  • No nudging or design techniques intended to encourage children to weaken their privacy settings

  • No sharing of children's data with third parties for commercial purposes

  • Location data not collected from children unless strictly necessary

  • Clear and accessible information about how data is used

 

3. Your Account

3.1 Account Registration

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You agree to promptly update your account information if it changes. Failure to provide or maintain accurate information constitutes a breach of these Terms and may result in immediate termination of your account.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You must:

  • Choose a strong password using a combination of upper and lower case letters, numbers, and symbols

  • Not share your password or account access with any third party

  • Not use another person's account without their express permission

  • Notify us immediately at security@rosocial.net if you suspect any unauthorised use of your account or any security breach

We will not be liable for any loss or damage arising from your failure to comply with these security obligations.

3.3 One Account Per Person

You may only maintain one personal account on RoSocial. Creating duplicate or false accounts, including impersonating another person or entity, is prohibited and may result in permanent suspension of all associated accounts.

3.4 Account Deactivation and Deletion

You may deactivate or delete your account at any time through your account settings. Upon deletion, we will process your request in accordance with our Privacy Policy and applicable data protection law. Certain data may be retained where required by law or for legitimate business purposes as set out in our Privacy Policy.

 

4. What You Can Do on RoSocial

Subject to these Terms and our Community Guidelines, RoSocial grants you a limited, non-exclusive, non-transferable, revocable licence to:

  • Access and use the Platform for personal, non-commercial purposes

  • Create and share content in accordance with these Terms

  • Interact with other users through comments, messages, reactions, and other platform features

  • Access features made available to you based on your account type and subscription

 

5. What You Must Not Do

You agree not to use the Service to:

  • Post, share, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or otherwise objectionable

  • Upload, post, or transmit any material that is sexually explicit, pornographic, or sexually suggestive in nature

  • Bully, intimidate, harass, stalk, or threaten any other person

  • Engage in any conduct that endangers or harms children or vulnerable individuals

  • Exploit or harm minors in any way, including by exposing them to inappropriate content or soliciting personally identifiable information from them

  • Impersonate any person or entity, or falsely claim an affiliation with any person or entity

  • Post content that promotes, glorifies, or facilitates self-harm, suicide, eating disorders, or other harmful behaviours

  • Promote, facilitate, or engage in any activity that constitutes a criminal offence in the United Kingdom or any other jurisdiction

  • Post content that incites hatred against or discriminates against individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic

  • Spread misinformation or deliberately false content designed to deceive or mislead other users

  • Upload or transmit viruses, malware, or any other malicious code

  • Attempt to gain unauthorised access to any part of the Service, its servers, networks, or any system connected to the Service

  • Use any automated means, bots, scrapers, or data-mining tools to access, collect, or extract data from the Service without our express written consent

  • Interfere with or disrupt the Service or servers and networks connected to the Service

  • Use the Service to send unsolicited commercial communications (spam)

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission

  • Circumvent, disable, or otherwise interfere with any security-related features of the Service

 

6. Content on the Platform

6.1 Your Content

You are solely responsible for any content you post, upload, transmit, or otherwise make available on or through the Service (“User Content”). By posting User Content, you represent and warrant that:

  • You own or have the necessary rights and licences to post the content and to grant us the licence described below

  • The content does not infringe any intellectual property right, privacy right, or any other right of any third party

  • The content does not contain any material that is unlawful, harmful, or violates these Terms or our Community Guidelines

  • You have obtained all necessary consents from individuals who appear in or who are identifiable from your content

6.2 Licence Granted to RoSocial

By posting User Content on the Service, you grant RoSocial a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with operating, providing, and improving the Service, including for promotional purposes.

This licence ends when you delete your User Content or your account, except where your content has been shared by others, in which case it may remain until those users also delete it.

6.3 Your Ownership

These Terms do not transfer ownership of your User Content to us. You retain all ownership rights in your User Content, subject to the licence granted above.

6.4 Content Moderation

We do not pre-screen User Content but reserve the right, in our sole discretion, to review, monitor, refuse, remove, or restrict access to any User Content that we determine violates these Terms, our Community Guidelines, or applicable law. Removed content may be retained by us as necessary for legal compliance purposes.

We maintain a dedicated Trust & Safety team and use a combination of automated tools and human review to detect and address harmful content on the platform, with particular attention to content that may harm children or vulnerable users.

6.5 Reporting Content

If you encounter content or behaviour that you believe violates these Terms or applicable law, please report it using the in-app reporting tools or by contacting us at safety@rosocial.net. We will investigate all reports and take appropriate action in accordance with our Community Guidelines.

 

7. Child Safety and Protection

The safety of children on our platform is a matter of the highest priority. In addition to complying with the UK Age Appropriate Design Code, we operate the following measures:

7.1 Prohibited Content Involving Minors

We have a zero-tolerance policy for any content that sexually exploits, abuses, or endangers children. This includes but is not limited to Child Sexual Abuse Material (CSAM) and any content that sexualises individuals under the age of 18. Such content will be immediately removed, reported to the National Centre for Missing & Exploited Children (NCMEC) and to the Internet Watch Foundation (IWF), and referred to law enforcement authorities.

7.2 Contact Features

We apply additional restrictions on messaging and contact features for users identified as minors, including restricting the ability of unknown adults to send direct messages to minor users. Users who are minors cannot receive direct messages from adults who are not already connected with them on the platform.

7.3 Grooming and Exploitation

We take all reports of grooming, exploitation, or inappropriate contact with minors extremely seriously. Any user found to be engaging in grooming behaviour or attempting to exploit or abuse a child will have their account immediately terminated and will be reported to the relevant law enforcement authorities.

7.4 Parental Controls

We provide parental supervision tools that allow parents or guardians to monitor usage, set time limits, and review the accounts and connections of minor users. We encourage parents and guardians to make use of these tools.

 

8. Privacy and Data Protection

Your privacy is extremely important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into and forms part of these Terms. We encourage you to read our Privacy Policy carefully.

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We are registered with the Information Commissioner's Office (ICO) under registration number ZC112192.

By using our Service, you acknowledge that we will collect, process, and use your data as described in our Privacy Policy.

 

9. Intellectual Property

9.1 RoSocial's Intellectual Property

The Service and all its original content (excluding User Content), features, and functionality are and shall remain the exclusive property of RoSocial Platforms and its licensors. This includes, without limitation, all text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software.

The RoSocial name, logo, and all related marks, names, and slogans are trademarks or registered trademarks of RoSocial Platforms. You must not use our trademarks without our prior written consent.

9.2 Copyright Infringement

RoSocial respects intellectual property rights and expects its users to do the same. If you believe your copyright has been infringed on our platform, please contact us at copyright@rosocial.net with the following information:

  • A description of the copyrighted work you claim has been infringed

  • A description of where the infringing material is located on our Service

  • Your contact information

  • A statement that you have a good faith belief that the disputed use is not authorised

  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf

It is our policy to terminate, in appropriate circumstances, the accounts of users who are found to be repeat infringers.

 

10. Links to Third-Party Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by RoSocial. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not endorse or make any representations about third-party sites.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites you visit. We will not be liable for any damage or loss caused or alleged to be caused by or in connection with the use of, or reliance on, any such third-party content, goods, or services.

 

11. Advertising and Commercial Content

RoSocial may display advertising content on the Service. Advertising displayed to users aged under 18 is subject to additional restrictions and we do not serve targeted advertising based on the profiling of minors. We will not knowingly display advertising for products or services that are inappropriate for children, including but not limited to alcohol, gambling, and adult content, to users we have identified as minors.

Some content on the platform may be paid for by advertisers or may be sponsored. Such content will be clearly labelled as such in accordance with applicable advertising standards and ASA guidelines.

 

12. Termination and Suspension

12.1 Suspension and Termination by Us

We reserve the right to immediately suspend, restrict, or permanently terminate your account and your access to all or part of the Service, without prior notice or liability, for any of the following reasons:

  • You have breached, or we reasonably suspect you have breached, these Terms or our Community Guidelines

  • You have engaged in conduct that we determine, in our sole discretion, to be harmful to other users, third parties, or the integrity of the Service

  • You have provided false or inaccurate information

  • Required to do so by law, court order, or relevant regulatory authority

  • We reasonably believe you pose a risk to child safety

Where permitted by law, we will notify you of the reason for any suspension or termination. You may appeal decisions affecting your account by contacting our appeals team at appeals@rosocial.net.

12.2 Termination by You

You may terminate your account at any time by using the account deletion feature in your settings or by contacting us at support@rosocial.net. Termination of your account will not relieve you of any obligations you incurred prior to termination.

12.3 Effect of Termination

Upon termination of your account, your right to use the Service will immediately cease. We may retain certain data in accordance with our Privacy Policy and applicable legal requirements.

 

13. Limitation of Liability

To the fullest extent permitted by applicable law, RoSocial, RoSocial Platforms, and their respective owners, employees, partners, agents, suppliers, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenues, data, goodwill, or other intangible losses

  • Any damage resulting from your access to or inability to access or use the Service

  • Any conduct or content of any third party on the Service

  • Any content obtained from the Service

  • Any unauthorised access to or use of our servers or any personal information stored therein

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, any breach of the terms implied by section 12 of the Supply of Goods and Services Act 1982, or any other liability that cannot be excluded or limited under applicable English law.

 

14. Indemnification

You agree to indemnify, defend, and hold harmless RoSocial, RoSocial Platforms, and their respective affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to:

  • Your use of or inability to use the Service

  • Your User Content

  • Your violation of these Terms

  • Your violation of any third-party rights, including intellectual property or privacy rights

  • Your violation of any applicable law or regulation

 

15. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that: (a) the Service will function without interruption or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

We make no warranties with respect to any User Content posted on the Service and are not responsible for the accuracy, usefulness, safety, or intellectual property rights of such content.

 

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

16.2 Jurisdiction

Both you and RoSocial agree that the courts of England and Wales shall have exclusive jurisdiction to settle any disputes arising from or in connection with these Terms, except that we retain the right to bring proceedings against you in the courts of the country in which you reside.

16.3 Alternative Dispute Resolution

In the event of a dispute, we encourage you to contact us in the first instance at legal@rosocial.net to attempt to resolve the matter informally. If a satisfactory resolution is not reached, you may also seek to resolve disputes through the EU Online Dispute Resolution platform if you are based in the EU or through other ADR schemes as appropriate.

16.4 Consumer Rights

If you are a consumer based in the United Kingdom, you have statutory rights under applicable consumer protection legislation, including the Consumer Rights Act 2015, that cannot be excluded or limited by these Terms. Nothing in these Terms affects those statutory rights.

 

17. Competitions and Promotions

From time to time we may run competitions, free prize draws, and promotions on the Service. These will be subject to separate terms and conditions, which will be made available at the time of entry. Such promotions will comply with the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code) and any other applicable regulations.

 

18. Accessibility

19. Changes to These Terms

We reserve the right to amend these Terms at any time. When we make material changes, we will:

  • Update the “Last Updated” date at the top of this document

  • Notify you via email to the address associated with your account

  • Display a prominent notice within the Service for a reasonable period

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.

Where required by applicable law (for example, for material changes affecting minors), we will seek affirmative consent before changes take effect.

 

20. General Provisions

20.1 Entire Agreement

These Terms, together with our Privacy Policy, Community Guidelines, and any other policies or agreements referenced herein, constitute the entire agreement between you and RoSocial regarding your use of the Service and supersede all prior and contemporaneous agreements, understandings, and communications.

20.2 Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, lawful, and enforceable, or severed from the Terms if modification is not possible. The validity and enforceability of the remaining provisions shall not be affected.

20.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver of any provision of these Terms will only be effective if made in writing and signed by an authorised representative of RoSocial.

20.4 Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

20.5 Force Majeure

We shall not be liable for any failure or delay in the performance of our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, civil unrest, governmental actions, or failure of third-party infrastructure.

20.6 No Third-Party Beneficiaries

These Terms do not confer any rights or remedies upon any third party other than you and RoSocial.
